Візуалізаційне обладнання для потреб медицини, стоматології та ветеринарної медицини (НК 024:2019 - 37623 Система рентгенівська ангіографічна стаціонарна, цифрова (Ангіографічна система))

Шановний учаснику! Ознайомившись із Вашим зверненням повідомляємо, що закупівля ангіографічної системи (код ДК 021:2015:33110000-4: Візуалізаційне обладнання для потреб медицини, стоматології та ветеринарної медицини, код НК 024:2019: 37623 — Система рентгенівська ангіографічна стаціонарна, цифрова) здійснюється КНП «НЦМЛ» (замовником) відповідно до Закону України «Про публічні закупівлі» від 25.12.2015 № 922-VIII (далі – Закон). Згідно ч. 1 ст. 25 Закону замовник має право зазначити в оголошенні про проведення конкурентної процедури закупівлі та в тендерній документації/оголошенні про проведення спрощеної закупівлі вимоги щодо надання забезпечення тендерної пропозиції/пропозиції. Тобто забезпечення тендерної пропозиції (встановлення вимоги про надання банківської гарантії) є правом, а не обов’язком замовника. Враховуючи нинішні тенденції, постійне зростання курсу валюти та комісійні винагороди банків за надання гарантійних забезпечень (що зумовлює зростання очікуваної вартості предмету закупівлі) КНП «НЦМЛ», як замовник тендеру, на даний час вважає недоцільним встановлення до учасників вимог про надання забезпечення тендерної пропозиції та/або виконання договору (банківської гарантії). Крім того, згідно умов закупівлі замовник здійснюватиме оплату товару після його прийняття (100% післяоплата), що в свою чергу гарантує замовнику отримання товару від постачальника незалежно від наявності / відсутності сторонніх забезпечень. Разом з тим умови оплати товару шляхом розстрочки платежу визначені замовником з урахуванням ризиків здійснення господарської діяльності підприємством, фінансових можливостей закладу охорони здоров’я та очікуваних грошових надходжень від Національної служби здоров’я України за укладеними договорами про медичне обслуговування населення. Having read your application, we inform you that the purchase of the angiographic system (DC code 021:2015:33110000-4: Visualization equipment for the needs of medicine, dentistry and veterinary medicine, NC code 024:2019: 37623 — X-ray angiographic stationary, digital system) is carried out by KNP " NCML" (customer) in accordance with the Law of Ukraine "On Public Procurement" dated 12.25.2015 No. 922-VIII (hereinafter - the Law). According to Part 1 of Art. 25 of the Law, the customer has the right to indicate in the announcement of the competitive procurement procedure and in the tender documentation/announcement of the simplified procurement the requirements for providing security for the tender offer/proposal. That is, securing a tender offer (establishing a requirement to provide a bank guarantee) is a right, not an obligation of the customer. Taking into account the current trends, the constant increase in the exchange rate and the commission fees of banks for the provision of guarantees (which leads to an increase in the expected value of the subject of procurement), KNP "NTSML", as the tender customer, currently considers it inexpedient to set requirements for the participants to provide security for the tender offer and/ or execution of the contract (bank guarantee). In addition, according to the terms of purchase, the customer will pay for the product after its acceptance (100% post-payment), which in turn guarantees the customer receipt of the product from the supplier regardless of the presence / absence of third-party collateral. At the same time, the terms of payment for the goods by installments are determined by the customer, taking into account the risks of the enterprise's economic activity, the financial capabilities of the health care institution, and the expected cash receipts from the National Health Service of Ukraine under concluded contracts for medical care of the population.
