No. RFQ RLNC-USPA-E-3 Project Repairing Essential Logistics Infrastructure and Network Connectivity Project Purchaser State Enterprise “Ukrainian Sea Ports Authority” Country Ukraine Issued on February 27, 2025 We kindly request your assistance in providing the following clarifications regarding the requirements specified in the tender documentation: Point 35 - Qualification requirements (a) Financial Capability “The Supplier shall demonstrate that they achieved a minimum average annual turnover of at least USD 9 million (nine million) calculated as total certified payments for contracts in progress and/or completed within the last three (3) years, divided by three (3). For a joint venture, this requirement shall be met by all the members combined.” You mention at this point that minimum average annual turnover of at least USD 9 million (nine million) calculated as total certified payments for contracts in progress and/or completed within the last three (3) years and in Annex 2 Quotation Forms – Financial Capability is mentioned a period of 5 (five) years. Question: Do we have to report to 3 (three) or 5 (five) years in order to demonstrate the minimum average annual turnover? (b) Specific Experience Question: In order to demonstrate that the requirement has been met – namely the successful delivery of at least three (3) tug pushers or other similar or more complex self-propelled vessles within the last five (5) years – would it be sufficient to submit acceptance certificates as proof of completion? Point 20-Quoted Price „20. The Supplier may express the Quotation price in any currency. If the Bidder wishes to be paid in a combination of amounts in different currencies, it may quote its price accordingly but shall use no more than three foreign currencies in addition to the currency of the Purchaser’s Country. The currency(ies) of the Quotation and the currency(ies) of payments shall be the same. If the Supplier is quoting its prices in more than one currency, in the electronic procurement system the Supplier shall indicate the equivalent of its total quotation price excluding VAT in Ukrainian Hryvnia, calculated based on the exchange rate established by the National Bank of Ukraine as of the date twenty-eight (28) days prior to quotations submission deadline. The exchange rates are available at the official website of the National Bank of Ukraine at the following link: https://bank.gov.ua/en/markets/exchangerates“ Question 1: If the Supplier will use one currency for Quotation (EURO or USD), where will it be indicated the currency symbol? (E.G.: In the form “Quotation for Goods: Price Schedule 1” there is no field for indicating the currency symbol.) Question 2: The Ukrainian Hryvnia currency shall be used only for “Total Quotation: Price Schedule 4”?  Point 33- 33 LIFTING CRANE It is required that the crane to be mounted in the aft part of the vessel. We need to install the crane in the vicinity of the boat as to allow proper launching/recovering of the boat, so the position of the crane will be determined by the location of the boat, not necessarily on the aft part of the vessel. Please confirm. Point 431 ANCHORS, CHAIN AND EQUIPMENT There is requested one (1) aft anchor. For this size of vessel and convoy maneuvered by the vessel it would result a very large anchor so we propose to use an equivalent solution based on two anchors, having the same capacity, but it will allow a better arrangement on the aft part of the vessel with more space available for towing and mooring. Please confirm. Point 503 SAFETY EQUIPMENT 50 LIFESAVINGS It is required a ship boat type inflatable with rigid bottom. Considering this type of vessel which is working on Danube river with irregular river banks, floating debris and other dangers for the inflatable type boat, we propose to allow the use of aluminium or fibre glass reinforced polyester boats as the Ship boat. Просимо розглянути та прийняти до уваги нижчевикладені пропозиції щодо змін умов в запиті на Технічні характеристики (тендерних умов), а саме: Підрозділ (Н) «Технічні характеристики» розділ «Класифікація» пропонуємо замінити фразу «Судно буде спроектовано та побудовано відповідно до Правил класифікаційного товариства IACS» на фразу «Судно буде спроектовано та побудовано відповідно до Правил класифікаційного товариства IACS або РСУ (РЕГІСТР СУДНОПЛАВСТВА УКРАЇНИ) ЗВАЖАЮЧИ НА МОЖЛИВІСТЬ БУДУВАННЯ СУДНА НА ТЕРИТОРІЇ УКРАЇНИ ТА ЗА ПРАВИЛАМИ УКРАЇНСЬКОГО РЕГІСТРА! . Враховуючи вищевикладене та з метою надання можливості приймати участь в даному тендері вітчизняному підприємству. ПРОСИМО: Відкоригувати умови Запиту на цінову пропозицію.

«Суднобудівно-судноремонтний завод «НІБУЛОН», як у складі ТОВ СП «НІБУЛОН» так і самостійно, як ТОВ «ССЗ «НІБУЛОН до повномасштабного вторгнення був лідером суднобудівельної галузі в Україні, має успішний досвід в будівництві морських та річкових суден, понад 50 штук, як за замовленням резидентів України так і з іноземними замовленнями. Під час війни, закінчив будівництво несамохідної баржі проекту В5000М, побудував 25- ти метрове судно проекту DCHC-25M та продовжує будувати баржу проекту В5000М. На сьогоднішній день надалі має можливість будувати повнокомплектні судна на своїх потужностях. При цьому, зазначені Замовником вимоги в надісланому ЗЦП є для Товариства обтяжливими через вищезазначені об’єктивні обставини знаходження країни в стані війни, що створює потенційну можливість виключення нашого підприємства в участі в цьому тендері. З огляду на складну фінансово-економічне становище в країні, падіння рівня ділової активності, завдання збитків підприємству внаслідок російської агресії просимо розглянути та прийняти до уваги нижчевикладені пропозиції щодо змін умов в запиті на цінову пропозицію (тендерних умов), а саме: 1) В підрозділі (А) «Фінансові можливості» розділу «Кваліфікаційні вимоги» пропонуємо замінити фразу «не менше 9 мільйонів доларів США (дев'яти мільйонів)» на фразу «не менше 4 мільйонів доларів США (чотирьох мільйонів)». 2) Підрозділ (Б) «Специфічний досвід» розділу «Кваліфікаційні вимоги» викласти в наступній редакції: «Постачальник, який є будівельником запропонованого буксира, повинен продемонструвати, що він самостійно або у складі іншого підприємства, на виробничих потужностях цього підприємства успішно побудував та завершив поставку принаймні трьох (3) буксирних штовхачів або інших подібних або більш складних самохідних суден протягом 10 років до кінцевого терміну подання цінової пропозиції. Також зважаючи на те, що побудоване судно буде використовуватися на внутрішніх водних шляхах України, просимо розглянути та прийняти до уваги нижчевикладені пропозиції щодо змін умов в запиті на Технічні характеристики (тендерних умов), а саме: Підрозділ (Н) «Технічні характеристики» розділ «Класифікація» пропонуємо замінити фразу «Судно буде спроектовано та побудовано відповідно до Правил класифікаційного товариства IACS» на фразу «Судно буде спроектовано та побудовано відповідно до Правил класифікаційного товариства IACS або РСУ (Регістр Судноплавства України) зважаючи на можливість будування судна на території України. Враховуючи вищевикладене та з метою надання можливості приймати участь в даному тендері вітчизняному підприємству. ПРОСИМО: Відкоригувати умови Запиту на цінову пропозицію.

Shipbuilding and Shiprepair Yard "NIBULON", both as part of LLC JV "NIBULON" and independently, as LLC "SSY "NIBULON" before the full-scale invasion was the leader of the shipbuilding industry in Ukraine, has successful experience in the construction of sea and river vessels, more than 50 pieces, both by order of residents of Ukraine and with foreign orders. During the war, it completed the construction of a non-self-propelled barge of the B5000M project, built a 25-meter vessel project DCHC-25M and continues to build a barge project B5000M. Today, it able to build full-completed vessels at its facilities. At the same time, the requirements specified by the Customer in the sent RFQ are burdensome for the Company due to the above-mentioned objective circumstances of the country being in a state of war, which creates the potential possibility for excluding our company from participating in this tender. Given the difficult financial and economic situation in the country, the decline in business activity, and the losses incurred by the enterprise as a result of Russian aggression, we ask you to consider and take into account the following proposals for changes to the conditions in the request for quotation (tender conditions), namely: 1) In subsection (A) “Financial Capabilities” of the “Qualification Requirements” section, we propose to replace the phrase “not less than 9 million US dollars (nine million)” with the phrase “not less than 4 million US dollars (four million)”. 2) Subsection (B) “Specific Experience” of the “Qualification Requirements” section shall be amended to read as follows: “The supplier who is the builder of the proposed tugboat must demonstrate that he has successfully built and completed the delivery of at least three (3) tugboat pushers or other similar or more complex self-propelled vessels, either independently or as part of another enterprise, at the production facilities of this enterprise, within 10 years prior to the deadline for submission of the price offer. Also, considering that the constructed vessel will be used on the inland waterways of Ukraine, we ask you to consider and take into account the following proposals for changes to the conditions in the request for Technical Specifications (tender conditions), namely: 3) Subsection (H) "Technical characteristics" section "Classification" we propose to replace the phrase "The vessel will be designed and built in accordance with the Rules of the IACS Classification Society" with the phrase "The vessel will be designed and built in accordance with the Rules of the IACS Classification Society or the RSU (Register of Shipping of Ukraine) taking into account the possibility of building the vessel on the territory of Ukraine.
